RECENT RESULTS AND SUCCESS

WORCESTER COUNTY

CHARGE: OUI Drugs;
Result: Not guilty; Jury Waived Trial.

The police claimed to have smelled a strong odor of burnt marijuana from the car and observed my client’s car failure to stop at a stop sign.  My client admitted to smoking marijuana less than an hour before driving and failed every Field Sobriety Test.  At trial, I successfully used established case law to discredit the observations of the officer and my client was not guilty!  Also, I was able to keep client from suffering any registry suspension or insurance surcharges for related civil infractions.

PLYMOUTH COUNTY

CHARGE: OUI liquor; Negligent Operation of a Motor Vehicle
Result: Not guilty; Jury Waived Trial. Licensed restored immediately.

The Commonwealth alleged that my client had glassy and bloodshot eyes, a strong odor of alcohol emanating from his breath, was unsteady on his fee and failed so-called Field Sobriety Testing. During the trial, I was able to attack the inconsistencies derived from those conclusions and win the case. Also, was able to win the subsequent hearing to fully restore my client’s license to operate a motor vehicle.

NORFOLK COUNTY

CHARGE: OUI liquor
Result: Not guilty; DIRECTED VERDICT! Licensed restored immediately.

Before the trial could reach a conclusion, I was able to elicit from the arresting officer that he failed to provide key evidence prior to trial. Subsequently, I moved for a directed verdict of not guilty, due to the government’s failure to provide discovery and the judge agreed. The judge immediately ordered a verdict of Not Guilty and my client won his case!

NORFOLK COUNTY

CHARGE: OUI liquor; 2nd Offense, Leaving the Scene of an Accident with Property Damage
Result: Not guilty; Jury Waived Trial.

The government argued that my client failed all Field Sobriety Tests, caused an accident and left the scene, had a strong odor of alcohol from his breath and was unsteady on his feet. I was able to keep out key evidence and successfully argue against the conclusions of the arresting officers. Verdict was a not guilty on all counts!

ESSEX COUNTY

CHARGE: Restraining Order
Result: Order NOT issued and judge found other side not credible on the record!

My client was accused of threatening the complaining party and her boyfriend with a gun. A restraining order had originally issued against my client and a hearing was scheduled for 10 days later. During the hearing, I was able to completely discredit the other side and the judge determined in his decision not to issue the restraining order, that the other side was lying.

PLYMOUTH COUNTY

CHARGE: OUI liquor; 2nd Offense, Negligent Operation of a Vehicle
Result: Case Dismissed; Licensed restored immediately (2nd not guilty/dismissal verdict for this client)

I motioned the court to dismiss the case by arguing that my client’s right to a speedy trial had been violated. The judge agreed and even restored her license!

BRISTOL COUNTY

CHARGE: OUI liquor; 2nd Offense, Negligent Operation of a Motor Vehicle
Result: Not guilty; Jury Trial. Licensed restored immediately.

The Commonwealth alleged that my client caused a minor car accident because she was impaired by alcohol. At trial, the inconsistencies and lack of a thorough investigation were exposed and the jury found my client not guilty of all charges! The judge restored her license to operate a motor vehicle after trial.

Result: Clerk’s Hearing; Charges not to issue

The police investigated a complaint that my client attempted to solicit a woman to perform a sexual act for a fee. After a hearing, I was able to discredit the complainant and keep my client from having the charge on his record. The clerk decided NOT to issue the complaint!
